Terms of Use

These terms set out the conditions for using the website, the official exhibitions app, the museum shop, and other related services provided by the Shibuya Higashi Archives. By using any of these services, you agree to these terms.

Article 1

Article 1 (Scope)

These terms establish, between the Shibuya Higashi Archives (the “Archives”) and the user, the conditions for using the website, the official exhibitions app, the museum shop, and all services incidental to them (together, the “Services”) provided by the Archives.

By using the Services, you are deemed to have agreed to all of these terms. If you do not agree, please refrain from using the Services.


Article 2

Article 2 (Definitions)

In these terms, “accessions” means the digital works, and the exhibition arrangements of them, that the Archives has produced by conserving, preparing, and recomposing high-resolution images that museums around the world have released into the public domain, under CC0, or on equivalent terms.

“user” means anyone who views or uses the Services.


Article 3

Article 3 (Intellectual property)

Copyright and all other intellectual property rights in the texts, compositions, designs, editorial expression, recomposed works, and their assemblages newly created within the Services belong to the Archives or to their rightful holders.

The Archives acts on the premise of respect for the original works, their makers, the holding institutions, and the released data. The sources and terms of the images used are stated on the relevant pages wherever possible; the rights in the original works themselves are governed by the terms of the institutions that released them.

Users may not reproduce, repost, modify, distribute, sell, or otherwise use the contents of the Services without the prior permission of the Archives.


Article 4

Article 4 (Prohibited acts)

In using the Services, users must not engage in any of the following.

1. Acts contrary to law or public order and morals.

2. Acts that infringe the rights, property, honor, or credit of the Archives, of other users, or of third parties.

3. Acts that obstruct the operation of the Services or damage the trust placed in the Archives.

4. Reproducing, modifying, or distributing the accessions or other displayed materials beyond the scope permitted.

5. Unauthorized access, the imposition of excessive load, or any other technical act that threatens the stable provision of the Services.

6. Demanding explanations of the works in a loud voice, or any other act that gravely disturbs the quiet of the premises.

7. Any other act that the Archives reasonably judges to be inappropriate.


Article 5

Article 5 (Changes and interruption of the Services)

The Archives may change the contents of the Services, or suspend or terminate their provision, without prior notice to users.

To preserve the silence of the stores as a whole, the screen may darken without notice. The Archives accepts no liability for disadvantage arising therefrom to users or to third parties. Should this occur, please allow a little time, and visit again.


Article 6

Article 6 (Disclaimers)

The Archives makes no warranty as to the accuracy, completeness, usefulness, or fitness for any particular purpose of the contents of the Services.

Except in cases of willful misconduct or gross negligence, the Archives is not liable for damage arising from the use of, or the inability to use, the Services.

The Archives bears no responsibility for the contents of external sites reached from the Services.


Article 7

Article 7 (Amendment of these terms)

The Archives may amend these terms without prior notice where it judges this necessary. The amended terms take effect when posted on the Services.

Use of the Services after amendment constitutes agreement to the amended terms.


Article 8

Article 8 (Governing law; contact)

These terms are interpreted and applied under the laws of Japan. Should a dispute arise between the Archives and a user in connection with the Services, resolution through sincere consultation comes first.

For inquiries concerning these terms, please use the contact point of the Archives. Your message will be reviewed, and you will receive a reply in due course from the staff member concerned — or from someone of a very similar quietness.
